Utmost Good Faith (Uberrimae Fidei)

 

 

An insurance contract is considered a contract of “utmost good faith.” Both the insured and the insurer are bound to act with complete honesty and to disclose all material facts. Failure by the insured to disclose relevant information (concealment) or making a false statement (misrepresentation) can lead to the voiding of the policy.
